Welcome to Shift Buddy. These Terms of Service outline the rules and regulations for the use of the Shift Buddy website and application.

By accessing or using our service, you agree to be bound by these terms. If you disagree with any part of the terms, you may not access the service.

1. Service Overview

Shift Buddy is a timesheet and scheduling software designed for field service businesses. We provide the tools for you to track employee hours, manage schedules, and collect relevant data such as GPS locations and odometer readings.

2. Roles and Responsibilities

Shift Buddy provides the software platform. We act as a data processor. The employer (the business account owner) is the data controller.

Employers are strictly responsible for complying with all relevant workplace surveillance laws and privacy regulations in their jurisdiction. This includes obtaining any necessary consent and notifying employees that their GPS location will be captured when they clock on and clock off using the app.

3. Billing and Subscriptions

We offer a 14-day free trial for new accounts. No credit card is required to start the trial.

After the trial period, access to Shift Buddy requires a paid subscription. We charge a flat rate of $4.95 AUD per active user per month. Billing is conducted monthly in advance.

There are no lock-in contracts. You can cancel your subscription at any time. Upon cancellation, you will retain access to your account until the end of your current billing cycle.

4. Data Access and Retention

Following the cancellation of your subscription, your data will remain available for export for a period of 30 days. After this 30-day period, we reserve the right to permanently delete your data from our active systems, subject to any legal retention requirements.

During your active subscription, we retain employment records for 7 years to assist with Fair Work Act compliance.

5. Acceptable Use

You agree not to use the service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. Limitation of Liability

Shift Buddy is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service.

To the maximum extent permitted by law, Shift Buddy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the service.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your use of the service will be subject to the exclusive jurisdiction of the courts of New South Wales.

8. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. We will provide reasonable notice of any significant changes. Your continued use of the service after any changes constitutes acceptance of the new terms.
